Platinum SMS, is a leading bulk SMS service provider in Delhi. By accessing or using our services, you agree to abide by these Terms and Conditions. If you disagree with any part, please discontinue use immediately.

  1. Introduction

Platinum SMS provides a range of SMS solutions to businesses and individuals, including bulk SMS campaigns, transactional messaging, and marketing communications. These terms govern your use of our services and are intended to outline your obligations, rights, and limitations. By using our services, you agree to these Terms, the Privacy Policy, and any additional guidelines or agreements specific to services offered by Platinum SMS.

  1. Eligibility and Account Creation

To use our services, you must:

  1. Be at least 18 years of age or the age of legal consent as per your jurisdiction.
  2. Provide accurate, current, and complete information when creating an account and maintain the accuracy of this information.
  3. Be responsible for maintaining the security and confidentiality of your account credentials.

Platinum SMS reserves the right to refuse service or terminate accounts found to be in violation of these Terms.

  1. Services Provided

Platinum SMS offers a suite of SMS-related services, which may include:

- Bulk SMS Campaigns: Messaging services for marketing, notifications, and alerts.

- Transactional Messaging: Non-promotional SMS services for transactional communication.

- Scheduling Tools: Tools to schedule and automate SMS sends.

We reserve the right to modify, suspend, or discontinue any aspect of our services at our discretion, with or without notice.

  1. User Obligations and Acceptable Use

As a Platinum SMS customer, you agree to use our services lawfully and responsibly. You must not:

  1. Engage in Spamming: Sending unsolicited, irrelevant, or excessive messages is prohibited. Messages should only be sent to recipients who have provided consent.
  2. Transmit Illegal or Offensive Content: Prohibited content includes, but is not limited to, material that is unlawful, defamatory, obscene, threatening, harassing, abusive, or infringing on the rights of others.
  3. Misrepresent Services: Users must not use Platinum SMS for fraudulent or deceptive communications.
  4. Use Services for Unlawful Activities: Activities in violation of any laws, including those pertaining to data privacy, are strictly prohibited.
  5. Interfere with Network Operations: You may not use the service in any way that disrupts or interferes with Platinum SMS’s network or services.

Platinum SMS reserves the right to suspend or terminate services if these obligations are not met.

  1. Payment and Billing

- Fees and Charges: All fees are charged based on the service plan chosen at registration. The amount due is specified in the service agreement.

- Payment Methods: Platinum SMS accepts payments via credit cards, bank transfers, and other specified methods. Details will be provided during the account setup.

- Non-Payment: Failure to make timely payments may result in suspension or termination of your services. Late payments may incur penalties as outlined in the service agreement.

- No Refunds: All payments are non-refundable except under certain conditions.

  1. Refund Policy

Refunds are only issued under the following circumstances:

- Service Interruption: If a prolonged service interruption occurs that is not due to your actions or a breach of this agreement.

- Billing Errors: If a verified billing error is identified, you may be eligible for a refund or credit.

Refund requests must be submitted within seven days of the relevant event. Platinum SMS reserves the right to evaluate each request on a case-by-case basis. All refunds, if applicable, will be processed within 30 business days.

  1. Usage Limits and Overages

Platinum SMS may impose limits on the number of messages sent as per your service plan. Exceeding these usage limits may result in overage charges. Users are encouraged to review their usage periodically to avoid unexpected fees. Any excess usage will be billed at the rate specified in the pricing structure associated with your service plan.

  1. Compliance with Laws and Message Content

As a Platinum SMS user, you are responsible for ensuring that your messaging content complies with all applicable laws, including data protection and consumer rights regulations. This includes:

  1. Obtaining Consent: You must secure consent from recipients before sending any promotional messages.
  2. Clear Identification: All messages must include identifiable sender information.
  3. Opt-Out Mechanism: Provide recipients with an option to opt out of further communications.

Failure to comply with these standards may result in suspension or termination of services.

  1. Intellectual Property

All content on the Platinum SMS platform, including text, graphics, logos, and software, is the property of Platinum SMS. Unauthorized use, copying, or redistribution of any material is prohibited. You may not reverse engineer, decompile, or modify any part of our platform.

  1. Data Privacy and Security

Platinum SMS prioritizes the security of your data. By using our services, you agree to our data practices outlined in our Privacy Policy, including data collection, processing, and storage measures.

- Confidentiality: Platinum SMS ensures the confidentiality of your data but is not liable for data breaches caused by third parties or unauthorized access to your account.

- Data Retention: We retain data only for as long as necessary for service provision and in compliance with applicable laws.

  1. Service Interruptions and Maintenance

Platinum SMS aims to maintain high availability but cannot guarantee uninterrupted services. Scheduled maintenance and unforeseen technical issues may result in downtime. Platinum SMS is not responsible for any losses or damages arising from service interruptions.

  1. Limitation of Liability

Platinum SMS, its affiliates, or employees are not liable for any indirect, incidental, or consequential damages arising from the use of our services. This includes, but is not limited to, damages for lost profits, data loss, or unauthorized access to user data.

Our maximum liability under these terms is limited to the fees you have paid within the last six months.

You agree to indemnify and hold Platinum SMS harmless from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or any third-party claims related to your messaging content or activities on our platform.

  1. Termination and Suspension

Platinum SMS reserves the right to terminate or suspend your access to our services at any time, with or without notice, for any of the following reasons:

  2. Non-Payment: Failing to make timely payments.
